Since the opponent does not easily see if you have 9 or 10 or more cards (it always shows "8+") I would recommend to get back to the rule that says drawing for color cards is not allowed if you have "8+".

The only difference to the Colo version played in the TTR League Heroes Tournament is the possibility to draw an open loko if you have 9 cards. I never thought this could be such an issue, as there are some players, who play this variation with the FUN-rules since months (Teddy1 for instance). As I said to Hecki before, the first player to complain about this change in rules, I really don't think this opens a door for cheating, because first the change in rule is very small as it only affects an open loko your opponent is allowed to draw while you see 8+ (taking from the deck is never allowed with 8+!!!) AND second, well, I really, really think everybody here can count to nine or ten... before the new version of TTR came out, all players had to count their cards to 44 and now you are not able to keep in mind if your opponent has nine or ten cards??? Just open your eyes and don't click that fast (like the rules say!).
To respond to ace, this tournament is NOT to be seen as an Honor System - as Mr. Atkinson said, the rules ALLOW playing non-rule-consistent tactics with the intension to face penalties - I always thought about a "loophole" of playing in this tournament like making a walkover (Durchmarsch) in Ramsch for those who play skat. But in one way, there always has to be an "Honor System": If your opponent catches you with more than 10 cards, you have to be a fair player and take the penalty without denying - he can proof it the next turn anyway like onyx shows:

I didn't play this very often, but I think it's quite interesting - this game offers you many ways to block several tix, so your opponent has to face the question wether to drop a tic or break the rules with a following penalty. Maybe you're right, onyx, and the penalty is not high enough and taking all three tix would be a more appropriate penalty (losing the game at once is too hard in my eyes), but changing the rules during the RR ain't a good thing - if there are more players, who complain about this game, we can change the rules for the KO Round or eventually drop the game for another one.

Addition to a rule gap:
no 5 or 6:

That was the essence of the penalty thoughts in all variations - it is a kind of lottery - you can be lucky with the tix found or face some ugly combinations that only lead to new penalty decisions.

Please remember the double penalty in the variation NO 5 OR 6, as I heard about a game with a penalty-player only taking one tic (and even two times due to two penalties)!
| DIGEST OF THE RULES |
Penalty: Draw (at least) 2 (in words: TWO) tickets THE VERY NEXT turn (in other words draw at least two of the three offered tix), if you lay a 5er or 6er track (this has to be a penalty ). The track points you get by wrongly played 5er or 6er track count!
SPECIAL CASE: If your opponent closes the game and you take a 5er or 6er track in your very last turn (with no chance to take tix in the next turn as penalty) you lose the game, irrespective of the points of this game, if your opponent says "penalty" before he takes his last turn!
