Children Privacy Policy

Days of Wonder, Inc. ("Days of Wonder", "we" or "us") welcomes users under 13 years of age (each a "Child" and collectively, "Children") to use our website, located at www.daysofwonder.com and our mobile applications (each an "Application") (collectively, the "Site"), and online services ("Services"). We have prepared this Children's Privacy Policy to describe to you our practices regarding collection, use and disclosure of personal information we collect from Children who have Accounts (as defined below) and explain each parent's or guardian's (each a "Parent" or "you") ability to review, request deletion of, or place certain restrictions on the collection, use, and disclosure of your Child's personal information.

Our general Privacy Policy, available at http://www.daysofwonder.com/about/privacy/, applies to all users of the Site and Services who are 13 years of age or younger. We are required under the Children Online Privacy Protection Act to obtain verifiable parental consent in order to collect, use or disclose personal information from Children. You may provide such consent by reviewing, signing and returning to us the Parental Consent Form, available at http://www.daysofwonder.com/coppa_fax/. If you provide such consent, you have agreed to the collection, use and disclosure of your Child's personal information in accordance with this Children's Privacy Policy. IF YOU DO NOT PROVIDE SUCH CONSENT, YOU MAY NOT ALLOW YOUR CHILD TO USE THE SITE OR SERVICES.

The Site and the servers that make the Site available are located in France. Personal information from Children may be collected and processed in France and may be transferred to the United States or other countries, where laws regarding processing of personal information from children may be less restrictive than the laws in your country.

Collection of Personal Information

We collect personal information from your Child in a variety of ways when your Child uses the Site and Services. Please note that we are prohibited from conditioning a Child's participation in a game, the offering of a prize, or another activity on the Child's disclosing more personal information than is reasonably necessary to participate in such activity. We may combine information we collect from you (see our general Privacy Policy) with information we collect from your Child.

Information Your Child Provides to Us.

  • We may collect personal information from your Child, such as your Child's e-mail, zip code, country, birthdate, login name and password when your Child creates an account to log in to our network ("Account").
  • If your Child uses our Services on a mobile device, including through our Application(s), we may collect the device's phone number and the unique device id number.
  • When connecting to our Services via a service provider that uniquely identifies the mobile device your Child is using, we may receive this identification and use it to offer extended services and/or functionality.
  • We retain information on your Child's behalf, such as files and messages that your Child store using his or her Account.
  • If your Child provides us feedback or contacts us via e-mail, we will collect your Child's name and e-mail address, as well as any other content included in the e-mail, in order to send your Child a reply.
  • When your Child posts content on our Site, the information contained in the posting will be stored in our servers and other users will be able to see it, along with your Child's login name. This information will be visible to others, including anonymous visitors to the Site.
  • When your Child participates in one of our surveys, we may collect additional profile information.
  • We also collect other types of personal information that your Child provides to us voluntarily.

Information Collected via Technology. To make our Site and Services more useful to your Child, our servers collect information from your Child, including your Child's browser type, operating system, Internet Protocol ("IP") address (which is the automatic number assigned to your Child's computer when your Child surfs the Web), domain name, and/or a date/time stamp for your Child's visit. We also gather certain information automatically and store it in log files. This information includes IP addresses, browser type, Internet service provider ("ISP"), referring/exit pages, operating system, date/time stamp, and clickstream data. In addition, we use cookies to collect information. "Cookies" are small pieces of information that a website sends to your Child's computer's hard drive while your Child is viewing the website. We may use both session cookies (which expire once your Child closes his or her web browser) and persistent cookies (which stay on your Child's computer until they are deleted). Cookies help us give your Child faster access to pages your Child has already visited, allow your Child to personalize your Child's pages, and help your Child to participate in some online activities on our Site. Your Child's IP address and cookies are not connected to any personal information. We may also collect non-personal information from the mobile device your Child is using if our Application(s) have been downloaded on the mobile device. Examples of information that may be collected and used include how your Child uses the Application(s) and information about the type of device your Child uses. In addition, in the event our Application(s) crashes on the mobile device your Child uses, we will receive information about the mobile device model software version and device carrier, which allows us to identify and fix bugs and otherwise improve the performance of our Application(s). We use Google Analytics to help analyze how users use the Site. Google Analytics uses Cookies to collect information such as how often users visit the Site, what pages they visit, and what other sites they used prior to coming to the Site. We use the information we get from Google Analytics only to improve our Site and Services. Google's ability to use and share information collected by Google Analytics about your visits to the Site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy.

How We Respond to Do Not Track Signals. We do not currently respond to "do not track" signals or other mechanisms that might enable consumers to opt out of tracking on our Site.

Our Use of Collected Information

We use the personal information we collect for the purposes indicated at the time your Child provides such information. In general, personal information your Child submits to us is used either to respond to requests that your Child makes, or to aid us in servicing your Child better. Occasionally, we might also e-mail your Child to provide information on upcoming Days of Wonder products, updates and promotions. If you want your Child to stop receiving such updates and product information from Days of Wonder or our affiliates at any time, just contact our Customer Service. Our mailings and e-mails will also include information allowing you to ask for your Child to not receive such information in the future. In addition, we use your Child's personal information in the following ways: to facilitate the creation of and secure your Child's Account on our network; to identify your Child as a user in our system; to provide improved administration of our Site and Services; to provide the Services your Child requests; to improve the quality of experience when your Child interacts with our Site and Services; to send your Child a welcome e-mail to verify ownership of the e-mail address provided when your Child's Account was created; to send your Child administrative e-mail notifications, such as security, or support and maintenance advisories; and to respond to your Child's inquiries or other requests.

We may create anonymous data records from personal information by excluding information (such as your Child's name) that makes the data personally identifiable to your Child. We use this anonymous data to analyze request and usage patterns so that we may enhance the content of our Services and improve Site navigation. We reserve the right to use anonymous data for any purpose and disclose anonymous data to third parties in our sole discretion.

The Sharing of Personal Information

Days of Wonder will never share, sell, rent or otherwise provide your Child's personal information to any outside companies or other party without your explicit consent except as described below. We may share your Child's personal information with third party service providers to: provide your Child with the Services that we offer you through our Site; to conduct quality assurance testing; to facilitate creation of accounts; to provide technical support; and/or to provide other services to us. If we do so, we require those other companies to sign confidentiality agreements. We may share some or all of your Child's personal information with our parent company, subsidiaries, joint ventures, or other companies under a common control ("Affiliates"), in which case we will require our Affiliates to honor this Children's Privacy Policy. We may share some or all of your Child's personal information in connection with or during negotiation of any merger, financing, acquisition or dissolution, transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. In the event of an insolvency, bankruptcy, or receivership, personal information may also be transferred as a business asset. If another company acquires our company, business, or assets, that company will possess the personal information collected by us and will assume the rights and obligations regarding your Child's personal information as described in this Children's Privacy Policy.

Certain portions of the information your Child provides to us may also be displayed in your Child's profile. As an essential element of the Services, some of the personal information your Child explicitly provides to us when your Child registers or updates his or her profile is displayed on your Child's profile. Your Child's photos, posts, friends, and other content your Child posts to the Site are also meant for public consumption. We may display this content on the Site, and further distribute it to a wider audience through third party sites and services. Once displayed on publicly viewable web pages, that information can be collected and used by others. We cannot control who reads your posting or what other users may do with the information that your Child voluntarily posts, so it is very important that your Child does not put personal information in his or her posts. Once your Child has posted information publicly, while you or your Child will still be able to edit and delete it on the Site, neither you nor your Child will be able to edit or delete such information cached, collected, and stored elsewhere by others (e.g., search engines).

If Days of Wonder believes disclosure of personal information is necessary to defend the rights or property of us or our Site and Services or anyone else, we may disclose the relevant personal information. We may also disclose personal information if we believe that the disclosure is required by law, or in response to a legal request.

As a Parent, you can review all of the information associated with your Child's Account by reviewing his Profile or by contacting our Customer Service.

Unsubscribing from Announcements - Opt-out Policy

From time to time, we send announcements by e-mail: news about coming games, important changes in our Site or Services, special offers, etc. Like you, we despise "spam," so we are very reasonable in the number of messages we send (typically no more than 1 or 2 a month). We also try to only send messages that are relevant to your Child's Account. For example, we send pre-order offers of Memoir '44 expansions only to users who registered their copy of Memoir '44. You may choose to completely turn off these announcements at any time by going to your Child's profile. You may also use the Unsubscribe page and enter the e-mail address that your Child used for your Child's Account. Please note that if you unsubscribe your Child's email, your Child will not receive any e-mails from us at all - even privileged offers. If you change your mind later, you may turn the announcements back on by returning to your Child's profile.

Other Choices Regarding Your Child's Information

Disclosure. You may prohibit us from disclosing your Child's personal information with a third party (including an Affiliate) by opting-out of such disclosures by contacting us below. However, you cannot prohibit us from sharing your Child's personal information with third party service providers, to defend the rights or property of us or our Site and Services or anyone else, or to comply with relevant laws or respond to a legal request. A Parent may prohibit us from disclosing the Child's personal information with a third party for the third party's marketing purposes by opting-out of such disclosures by contacting us below.

Review. You may review your Child's personal information by logging into your Child's account or by sending us an e-mail or postal mail at the address below.

Retention. We will retain your Child's personal information for only as long as is reasonably necessary to fulfill the purpose for which the information was collected.

Deletion. You may request deletion of your Child's personal information by sending us an e-mail or postal mail at the address below. IN SUCH CASE, WE WILL NO LONGER ALLOW YOUR CHILD TO USE THE SITE OR SERVICES. We will delete your Child's information using reasonable measures to protect against unauthorized access to, or use of, the information in connection with its deletion. When we delete a Child's personal information, it will be deleted from our active databases but we may retain an archived copy of your records as required by law or for legitimate business purposes.

Refusing Further Collection or Use. You may at any time refuse to permit our further use or future online collection of your Child's personal information, by terminating your Child's Account and directing us to delete your Child's personal information (as described above). IN EITHER CASE, WE WILL NO LONGER ALLOW YOUR CHILD TO USE THE SITE OR SERVICES. Upon a Parent's request, we will delete the Child's Account and all the information and data stored for such Account. We will not have any liability whatsoever for any termination of the Account or related deletion of the Child's personal information. After termination, your Child will not be able to use his or her Account anymore. Online gaming, services, privileges and other features will no longer be available to your Child.

Reliance on Parental Instructions. We may, and you authorize us to, rely on the instructions that we reasonably believe are given by you as a Parent. For example, if a person calls our customer support number and provides the account information we request, we may assume that the person calling is the Child's Parent. We will not be held liable for any disclosure made in good faith and following reasonable procedures in responding to a request for disclosure of a Child's personal information from the Parent.

Cookies. If you decide at any time that you no longer wish for your Child to accept cookies from our Service for any of the purposes described above, then you can instruct your Child's browser, by changing its settings, to stop accepting cookies or to prompt you before accepting a cookie from the websites your Child visits. Consult your browser's technical information. If you do not allow your Child to accept cookies, however, your Child may not be able to use all portions of the Service or all functionality of the Service.

Applications. You can stop all collection of information by the Application(s) by uninstalling the Application(s). You may use the standard uninstall processes as may be available as part of the mobile device that your Child is using or via the mobile application marketplace or network.

Third Party Websites

Our Site may contain links to third party websites. When your Child clicks on a link to any other website or location, your Child will leave our Site and go to another site and another entity may collect personal information or anonymous data from your Child. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of this Children's Privacy Policy and our general Privacy Policy do not apply to these outside websites or content, or to any collection of your personal information after your Child clicks on links to such outside websites. We encourage you to read the privacy policies of every website your Child visits. The links to third party websites or locations are for convenience and do not signify our endorsement of such third parties or their products, content or websites.

Security of Your Personal Information

We are committed to protecting the security of your Child's personal information. We have established and maintain reasonable procedures to protect the confidentiality, security and integrity of personal information collected from Children. We use a variety of industry-standard security technologies and procedures to help protect your Child's personal information from unauthorized access, use, or disclosure. In addition, we take reasonable steps to release Children's personal information only to third parties who are capable of maintaining the confidentiality, security and integrity of such information, and who provide assurances that they will maintain the information in such a manner. We also require your Child to enter a password to access his or her Account information. Please instruct your Child to not disclose his or her Account password to unauthorized people. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we use reasonable efforts to protect your Child's personal information, we cannot guarantee its absolute security.

Changes to This Children's Privacy Policy

This Children's Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Children's Privacy Policy by posting the new Children's Privacy Policy here at http://www.daysofwonder.com/about/children-privacy and we will change the "Last Revised" date above. You should consult this Children's Privacy Policy regularly for any changes. Except as otherwise provided in this Children's Privacy Policy, any changes to this Children's Privacy Policy will be effective immediately for new users of the Site and Services.
